Welcome to Pevnori. The terms "we", "us" and "our" refer to Pevnori. Pevnori operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Pevnori is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (the "Terms of Service" or "Terms"), govern your access to and use of the Services.

Please read these Terms carefully. They contain important information concerning your legal rights, including product-use requirements, warranty disclaimers and limitations of liability.

An order is not accepted until we confirm acceptance. Payment must be successfully authorised and processed before an order can be completed.

Please review your order carefully before submitting it. We may be unable to change or cancel an order once it has been accepted or entered fulfilment.

If we decline, change or cancel an order, we may attempt to contact you using the contact information supplied with the order.

Products purchased through the Services are intended for personal or household use unless we expressly agree otherwise. We reserve the right to limit or cancel orders that reasonably appear to be placed for unauthorised commercial resale or redistribution.

SECTION 4 - PRICES, BILLING, TAXES AND IMPORT CHARGES

Prices, discounts and promotions may change without notice. The price applicable to your purchase will be the price displayed when your order is placed, subject to correction of obvious errors as permitted by law.

Promotions may be subject to separate terms. If specific promotional terms conflict with these Terms in relation to that promotion, the promotional terms will apply.

You represent that you are authorised to use the payment method submitted and agree to pay the charges properly incurred in connection with your purchase, including applicable shipping charges and taxes.

SECTION 5 - SHIPPING AND DELIVERY

Estimated processing, shipping and delivery timeframes are those displayed through the Services, at checkout or in our applicable shipping information at the time you place your order.

All delivery dates and timeframes are estimates unless we expressly state otherwise.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, transportation disruption, severe weather and other events.

We will handle shipping delays, cancellations and refunds in accordance with applicable law.

You are responsible for providing a complete and accurate delivery address. Pevnori is not responsible for delays, losses or delivery failures caused by incorrect or incomplete delivery information supplied by you.

Delivery Confirmation

Tracking information and delivery confirmation provided by the applicable carrier may be relied upon by Pevnori as evidence that an order was delivered to the shipping address provided at checkout.

If an order is shown as delivered by the carrier but you believe it has not been received, please contact us so that the matter can be investigated.

Nothing in this section excludes or limits any rights or remedies that cannot lawfully be excluded or limited.

SECTION 6 - INTELLECTUAL PROPERTY

Pevnori is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Pevnori.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Pevnori, including any injury, damage or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Pevnori.

You represent that you own or otherwise have the necessary rights to provide the Feedback and that your Feedback does not unlawfully infringe the rights of another person.

You are responsible for the accuracy and legality of Feedback you submit.

We may monitor, edit or remove Feedback where we determine that it violates applicable law, third-party rights or these Terms.

We do not warrant that access to the Services will always be uninterrupted, timely, secure or error-free.

Nothing in these Terms excludes a warranty, guarantee or other right that cannot lawfully be excluded.

SECTION 17 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Pevnori and its service providers, contractors, agents and representatives will not be liable for any indirect, incidental, special, exemplary, punitive or consequential loss, damage, cost or expense arising out of or relating to the Services, these Terms, any product purchased through the Services, or the use or attempted use of any such product. This includes, where permitted by applicable law, loss of profits, revenue, savings, data, goodwill, business opportunity or other indirect economic loss, regardless of whether Pevnori was advised of, knew of, or could reasonably have foreseen the possibility of such loss or damage. The exclusions in this section apply regardless of the legal basis on which a claim is brought, including contract, tort or negligence, except to the extent that applicable law does not permit such liability to be excluded or limited. Without limiting the Product Safety and Proper Use provisions in Section 2, Pevnori will not, to the fullest extent permitted by applicable law, be responsible for loss, damage or injury resulting from misuse, improper use, incorrect fitting or sizing, unauthorised alteration, failure to follow instructions or warnings, or use of a product for a purpose for which it was not designed or intended. Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, liability arising from defective or misdescribed goods where such liability cannot lawfully be excluded, or any other liability or consumer right that applicable law does not permit us to exclude or limit.

SECTION 18 - INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Pevnori, Shopify and their respective service providers, contractors, agents and representatives from third-party claims, losses, liabilities, damages and reasonable costs arising from your breach of these Terms, unlawful misuse of the Services, violation of applicable law or infringement of another person's rights.

This obligation applies only to the extent permitted by applicable law.

SECTION 19 - SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in effect.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce a right under these Terms does not waive that right.

These Terms, together with the policies expressly incorporated into them, constitute the agreement between you and Pevnori concerning your use of the Services and supersede prior versions concerning the same subject matter.

These Terms and any separate agreements through which Pevnori provides the Services are governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising from or relating to these Terms or the Services, except where applicable law requires otherwise.

Headings are included for convenience only and do not affect the interpretation of these Terms.

SECTION 24 - CHANGES TO THESE TERMS

We may update these Terms from time to time by posting an updated version through the Services.

Where applicable law requires notice of a material change, we will provide such notice.

Changes will apply from the effective date specified in the updated Terms or otherwise from the date they are posted, subject to applicable law.
